How Consumer Rights Affect Ninety’s CARE & Ninety’s CARE

THE BENEFITS CONFERRED BY THIS PLAN ARE IN ADDITION TO ALL RIGHTS AND REMEDIES PROVIDED

UNDER CONSUMER PROTECTION LAWS AND REGULATIONS. THIS PLAN SHALL NOT PREJUDICE THE RIGHTS GRANTED BY APPLICABLE CONSUMER LAW, INCLUDING THE RIGHT TO RECEIVE REMEDIES

UNDER STATUTORY WARRANTY LAW AND TO SEEK DAMAGES IN THE EVENT OF THE NONPERFORMANCE BY 90Ninety’s OF ANY OF ITS CONTRACTUAL OBLIGATIONS.


  1. The Plan

This contract (the “Plan”) governs the services provided by 90Ninety’s under the above plans and will be provided to you at the time of purchase.

Benefits under this Plan are additional to your rights under applicable laws, the manufacturer’s hardware warranty and any complimentary technical support. The terms of the Plan only apply paid for on a one-time basis (“Single-Pay Plan”) unless otherwise noted.

The Plan covers the following products (collectively, the “Covered Product(s)”): (i) the Ninety’s products (including, but not limited to any products produced by Ninety’s and non out of stock ), and (ii) the accessories contained inside the original packaging of your Covered Product(s).

Coverage begins when you purchase the Plan and continues through, unless redeemed, the date specified in your Plan Confirmation (the “Plan Term”).

  1. What is Covered?

2.1 Defects 

If during the Plan Term, you submit a valid claim by notifying 90Ninety’s that a defect in materials and workmanship has arisen in the Covered Product(s).

90Ninety’s will either: (i) repair the defect at no charge, 

or (ii) exchange the Covered Product(s) with a replacement product or equivalent gift card. 

All exchange products provided under this Plan will at a minimum be functionally equivalent to the original product. If 90Ninety’s exchanges the Covered Product(s), the original product becomes 90Ninety’s property and the replacement product is your property, with coverage ineffective for the replacement product for the remainder of the Plan Term.


2.2 Services for Accidental Damage 

If during the Plan Term you submit a valid claim by notifying 90Ninety’s that the Covered Product(s) has failed due to accidental damage from handling resulting from an unexpected and unintentional external event (such as, drops and damage caused by liquid contact), 

90Ninety’s will either (i) repair the defect at no charge, 

or (ii) exchange the Covered Product(s) with a replacement product or equivalent gift card. 

All exchange products provided under this Plan will at a minimum be functionally equivalent to the original product. If 90Ninety’s exchanges the Covered Product(s), the original product becomes 90Ninety’s property and the replacement product is your property, with coverage ineffective for the replacement product for the remainder of the Plan Term.


2.3 Services for Accidental Loss

During the Plan Term, you submit a valid claim by notifying 90Ninety’s that the Covered Product(s) has failed due to accidental loss from handling resulting from an unexpected and unintentional external event.

90Ninety’s will either (i) replace the Covered Product(s) with a replacement product or equivalent gift card. 

All exchange products provided under this Plan will at a minimum be functionally equivalent to the original product. If 90Ninety’s exchanges the Covered Product(s), the original product becomes 90Ninety’s property and the replacement product is your property, with coverage ineffective for the replacement product for the remainder of the Plan Term.


  1. What is not Covered?

90Ninety’s may restrict the coverage to the country where the Covered Product(s) was originally purchased.

90Ninety’s will not provide coverage in the following circumstances:

(a) to conduct preventative maintenance;

(b) damage caused by reckless, abusive, willful or intentional conduct;

(c) to install, remove or dispose of the Covered Product(s) 

(d) any damage to Covered Product(s) (regardless of the cause) if the Covered Product(s) has been, serviced, modified, installed or altered by anyone other than 90Ninety’s or an authorized representative of 90Ninety’s; 

(e) any damage to receipt with the order number that has been altered, defaced or removed; 

(f) damages caused by fire, earthquake or other external causes.

(g) failed to provide the contact information that matches the order of Ninety’s CARE purchase.

Important: The restriction does not prejudice your consumer law rights.


  1. How to Obtain Service?

You may obtain service by contacting our customer service. You must also, upon request, provide the sales receipt for your Ninety’s CARE.


  1. Service Options

90Ninety’s will provide service to you through one or more of these options:

(a) Carry-in service. Carry-in service is available for most Covered Product(s). Return the Covered Product(s) to a designated location that offers carry-in service.

(b) Mail-in service. Direct mail-in service is available for most Covered Product(s). If 90Ninety’s determines that your Covered Product(s) is eligible for mail-in service, 90Ninety’s will send you waybills (and, if needed, packaging material). You must ship the Covered Product(s) to 90Ninety’s in accordance with 90Ninety’s instructions. Once service is complete, 90Ninety’s will return the Covered Product(s) to you. (90Ninety’s will NOT pay for shipping to and from your location.)


  1. Your Responsibilities

To receive service or coverage under the Plan, 

you agree to 

(i) provide your Ninety’s CARE order number and a copy of receipt, 

(ii) provide information about the symptoms and causes of the issues with the Covered Product(s), 

(iii) respond to requests for information needed of the Covered Product(s), and 

(iv) follow instructions that 90Ninety’s gives you.


  1. General Terms

(a) 90Ninety’s may subcontract or assign performance of its obligations to third parties but shall not be relieved of its obligations to you in doing so.

(b) 90Ninety’s is not responsible for any failures or delays in performing under the Plan that are due to events outside of 90Ninety’s reasonable control.

(c) You are not required to perform preventative maintenance on the Covered Product(s) to receive service under the Plan.

(d) You agree that once 90Ninety’s redeemed your valid claim, the replacement product for the remainder of the Plan Term ends. 90Ninety’s future obligations under this Plan to you are fully extinguished. 

(e) 90Ninety’s  is not obligated to renew this Plan. If 90Ninety’s does offer to renew this Plan, 90Ninety’s will determine the price and terms.

(f) There is no informal dispute settlement process available under this Plan.

(g) Product availability may vary by jurisdiction. The laws of the Special Administrative Region of Hong Kong will control if inconsistent with any other provisions of this Plan

(h) I have carefully read and understood the terms and conditions of this Plan and agree to be bound by the related terms and conditions once this Plan purchased.

(i) 90Ninety’s reserves the rights of final decision, including suspending, terminating or changing details of the Plan and its terms and conditions without prior notice.

(j) In case of any inconsistency between the English and Chinese versions of these terms and conditions, the English version shall prevail.
